DJ Companion Records – Create Your Own Ad Competition - Rules and Regulations
1. INTRODUCTION: DJ Companion Records "Create Your Own Ad" Competition (the "Competition") is sponsored by DJ Companion Records ("Sponsor"), 1623 Military Rd. #509 Niagara Falls, NY 14304. The Competition is open to legal residents of the fifty (50) United States and the District of Columbia and legal residents of Canada who have reached the age of majority in their jurisdiction of residence at the time of entry. Employees of Sponsor and its respective affiliates, parents, subsidiaries, and advertising and promotion agencies involved with this Competition, and the immediate family members and/or those living in the same household of each are more than welcome to participate. The Competition will run from 05/01/09 at 12:01:00 AM (ET) through 07/15/09 at 11:59:59 PM (ET).
2. HOW TO ENTER: Go to www.djcompanionrecords.com and email to rob@djcompanionrecords.com either the dialogue for a one minute commercial or a media file (mp3 or wav preferred) one minute in length. As a condition of entry, you will be required to accept and agree to be bound by these Official Rules. You may submit up to three entries that demonstrate your response to mission of positively promoting products at DJ Companion Records. On the subject line indicate “COMPETITION ENTRY”. Entries must be submitted no later than 11:59P.M. (ET) on 07/15/09 to qualify for the Competition. You may submit more than one entry in accordance with the entry process, but you cannot submit the same entry more than once. Entries become the sole property of Sponsor and will not be returned.
Upon submission, all commercials will be reviewed by the Sponsor to determine if the commercial will considered based on the following criteria:
1. Is there any inappropriate content (inappropriate or foul language, excessive violence)?
2. Does the commercial present a positive depiction of the company?
3. Does the commercial hold the viewers interest?
4. Is the commercial brand appropriate?
5. Would customers of DJ Companion Records enjoy watching the commercial?
6. Does the commercial have appropriate viral "buzz" value?
Sponsor reserves the right in its sole discretion to select the number, if any, of commercials worthy of broadcast, posting, or other use out of the total number submitted.
3. ENTRY REQUIREMENTS/CLEARANCES: ENTRY REQUIREMENTS/CLEARANCES: All entries must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. All signatures must be original. By submitting an entry, entrant warrants and represents that he/she and any persons appearing or identifiable in the entry consent to the submission and use of the video in the Competition, to its posting on the Internet in connection with the Competition, and in any subsequent promotion of the Sponsor and/or Competition. The entry must not, in the sole and unfettered judgment of the Sponsor, contain any sexually explicit, disparaging, libelous or other inappropriate content or nudity.
4. RIGHT TO DISQUALIFY: The Sponsor reserves the right, in its sole and unfettered discretion, to disqualify and remove at any time during the contest any entry that potentially or actually infringes any third party's copyright(s). Sponsor reserves the right, in its sole and unfettered discretion, to disqualify and remove any entry that it believes contains any sexually explicit, disparaging libelous or inappropriate content, is not suitable for publication, infringes the rights of any third party or otherwise does not meet any other requirements in these Official Rules. Sponsor further reserves the right, in its sole and unfettered discretion, to verify at any time during the Competition that all necessary Clearances have been obtained and to disqualify and remove any entry if it believes that the necessary Clearances have not been obtained.
5. FINAL JUDGING: The entries will be judged by a yet to be determined panel of judges to select the one Grand Prize winner based on the following criteria: Originality and creativity - 60%; and Overall appeal - 40%. In the event of tie, both winners shall receive the Grand Prize.
PRIZES: (1) Grand Prize – A complete DJ Companion Records cd library consisting of all cds currently in release by DJ Companion Records. (20) Early Bird Prizes – The first 20 non-disqualified entries shall receive their choice of one DJ Companion Records release from the following 3: Wild Wilson: The Best of Comedy and Drops, Fern Viola: Anthems or Fern Viola: My Faith. No substitution or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. All federal, state and local taxes on prizes are the sole responsibility of the prize winners.
6. GENERAL RULES: The Competition is governed by and subject to the laws of the United States. All federal, state, and local laws and regulations apply. Void where prohibited by law. All prize winners will be notified by email, or telephone at the contact information provided by the entrant and must sign and return any applicable documentation deemed necessary by Sponsor, including all required Clearances, an Affidavit of Eligibility and Liability/Publicity Release, within forty-eight hours (48) following attempted notification. Noncompliance within this time period may result in disqualification and an alternate winner may be selected. By entering Competition, entrants give the Sponsor the right to publish, use, adapt, edit and/or modify such entry in any way, in any and all media and without consideration to entrant or other identifiable persons depicted in the video and winner irrevocably assigns and transfers all rights, title and interest in the submission to the Sponsor and, if required, will sign any documents necessary to transfer copyright. By entering Competition and/or accepting prize, entrant grants permission to Sponsor and their agencies to use winners' name and/or likeness for purposes of advertising, publicity and promotional purposes, without further compensation to entrant unless prohibited by law. Prizes are non-transferable. By accepting prize, winner agrees to hold Sponsor, their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use/redemption of any prize. Entrants agree to be bound by the Official Rules and the decisions of the judges which are final and binding on all matters relating to this Competition. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prizes.
7. Sponsor is not responsible for any electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest.
